Madlanga & Partners Inc. Attorneys and its professional team have in the past undertaken various notable key projects and, some of them are still on-going and include the following:

  • Advising PIKITUP Johannesburg (SOC) Limited, Board of Directors with regard to legal review of the National Treasury Report, analysis of the Legal Regulatory and Compliance Framework, interaction between MPI, National Treasury Management and Board of Pikitup including providing legal advice to the Board of Directors of Pikitup.
  • Appointed by Pikitup to Initiate/Prosecute disciplinary proceedings on behalf of the Employer (Pikitup) against its Managing Director for serious allegations of financial misconduct with regard to floating of Supply Chain Policies and other procurement related matters including but not limited to PFMA, MFMA, MSA, and RSA Constitution.
  • Acting on behalf of SADTU in the internal disciplinary hearing of the National Department of Basic Education (“Employer”) against its Director General, on matters related to serious allegations on financial misconduct.
  • Drafting Regulatory Impact Assessment (“RIA”) on the Home Loan and Mortgage Disclosure Amendment Bill for the Department of Human Settlements.
  • Drafting Regulatory Impact Assessment (“RIA”) on the Property Practitioners Bill for the Estate Agency Affairs Board (“EAAB”).
  • Prosecuting/Initiating disciplinary proceedings on behalf of Road Transport Management Company (“RTMC”), the employer against its senior employees on procurement and PFMA related matters and allegations of irregularities and financial misconduct.
  • Conducting investigations on the protest strike by learners at Filaldefia School for the Disabled on behalf of Gauteng Department of Education including interviewing all the concerned stakeholders and prepared report and made recommendations.
  • Providing commercial advisory services on a shareholder dispute including acting for the plaintiff in the matter of Lumeka Mining (Pty) Ltd / Warrior Coal Investments (Pty) Ltd & 2 Others.
  • Training and drafting of the Pieces of Legislation administered by the Department of Human Settlement (“DHS”).
  • Conducted Due Diligence Investigation on Estate Agency Affairs Board (EAAB), acting on behalf of Department of Human Settlements (“DHS”) which culminated to the drafting of a Bill transferring EAAB from DTI to DHS;
  • Conducting Legal Due Diligence of the National Housing Finance Corporation (“NHFC”); The National Urban Reconstruction and Housing Agency (“NURHA”); and the Rural Housing Loan Fund (RHLF) in preparation for the Amalgamation of the Institutions;
  • Acting on behalf of South African Democratic Teachers Union (“SADTU”) and all other Teacher Unions and affiliates, at Labour Court against Department of Basic Education (“DBE”) In re: cancellation of the Collective Bargaining Agreement;
  • Contract Reviews and mini-due diligence review of service providers for the Gauteng Department of Local Government and Housing including providing detailed reports;
  • Contract drafting, vetting and creating of template precedent, Standardisation and Management of Contracts for Municipal Infrastructure Support Agent (“MISA”);
  • Chairing and Prosecution of disciplinary enquiries on behalf of Railway Safety Regulator (“RSR”);
  • Providing Legal Opinions to Education Labour Research Council (“ELRC”) on Administrative and Constitutional Law and on Labour and Employment Law;
  • Chairing and Prosecuting disciplinary hearings on behalf of the Eastern Cape Department of Transport (“ECDOT”);
  • Litigations on behalf of Umzimvubu Local Municipality (“ULM”) defending damages claims and on certain occasions instituting High Actions and Interlocutory Applications on behalf of the Municipality;
  • Property and Conveyancing on behalf of Johannesburg Social Housing Company (“JOSHCO”) Transfer of Land and Eviction Applications;
  • Providing Legal Opinions on behalf of Rand Water (“RW”) and other various institutions like Asgisa-EC;
  • Commercial Litigations on behalf of Khumbula Property Services (“KPS”), in the South Gauteng High Court against Department Of Transport, Roads And Public Works- Northern Cape Province; Guardrisk Insurance Company Limited; Thabo Gladstone Ntshiqa; GM Financial Services CC; and Gerhard Marais;
  • Chairing numerous appeal hearings at Financial Services Board (“FSB”);
  • Chairing disciplinary hearings on behalf of National Home Builders Regulatory Council (“NHBRC”) and attending to litigations matters;
  • Licence and permit applications before the various Provincial Regulatory Entities and litigations thereof on behalf of Autopax Passenger Services (“APS”) including appearances in Quasi-Judicial hearings before PRE, and attending to High Court Review Applications;
  • Land Claims and Restitutions on behalf of Department of Rural Development and Land Reform (“DRDLR”) including offering mediation and arbitration services and other Alternative Dispute Resolutions (“ADR”) including Court Appearances at Land Claims Court;
  • AsgiSA-EC and Winding Up: Merger of ECATU; ECRFC and AsgiSA-EC to form Eastern Cape Rural Development Agency (“ECRDA”);
  • Coega IDZ: Cycle Combined Gas Turbine project (CCGT) including conducting and producing Feasibility Study, issuing of Expression of Interest “EOI”) for the appointment of Independent Power Producers (“IPP”);
  • TRANSNET: Sale of Assets – (Tanks and other movable assets); to Sasol;
  • MBOMBELA Consortium: Gautrain rapid rail, from the drafting of Concessionaire Agreement until the train ran, in multi-disciplinary transaction, representing BEE, component of Mbombela Consortium, Strategic Partners Group (“SPG”);
  • Alfred Nzo District Municipality: successfully interdicted the unlawful and unprotected strike at Durban Labour Court.
  • South African Civil Aviation Authority (“SACAA”): High Court applications on Public Administrative Justice Act (“PAJA”) and Administrative and Constitutional Law matters provided legal opinions on powers the Minister to appoint and dismiss Directors.
  • Claim for damages case against Minister of Police / Zizi Goodenough Kodwa, at South Gauteng High Court, and other delist cases before various Courts;
  • Commercial litigation and Highly specialised legal advice to South African Airways. Defended SAA in North Gauteng High Court in a claim for damages and settled the matter using ADR;
  • Defending tender irregularity and acting on behalf of Municipal Infrastructure Support Agency (“MISA”) and including attending to the issues that relates to the access of information required by the aggrieved party in the tender process.
